Venders Declaration:
The vendor warrants, acknowledges and declares:
That the vehicle particulars described in this document are true and correct.
1. The vendor is authorized to sell the vehicle described and is able to give BROKEN CAR COLLECTION JSGH LTD a valid and unencumbered title to the vehicle free from registered or unregistered securities.
2. That all securities and monies owed against the vehicle have been disclosed to BROKEN CAR COLLECTION JSGH LTD. The vendor authorises BROKEN CAR COLLECTION JSGH LTD to obtain settlement figures where the vehicle is secured.
3. That the vehicle is not liable to be seized or forfeited to the Customs Department or other authority.
4. The vehicle has not been water/flood damaged and has not had chassis repair or been an insurance write off, unless the vehicle is a damaged vehicle and these details have been disclosed above.
5. That BROKEN CAR COLLECTION JSGH LTD is authorised and directed to pay any amount owing to parties having secured interest(s) in the vehicle or parties having charges or debts owing with respect to the vehicle and to deduct same from the amount offered by BROKEN CAR COLLECTION JSGH LTD.
6. If any security registered or unregistered exists that exceeds the amount offered by BROKEN CAR COLLECTION JSGH LTD, this contract shall become null and void.
7. Where road user charges apply, the vendor warrants that all charges are up to date at the time of this transaction or if not up to date authorises BROKEN CAR COLLECTION JSGH LTD to deduct such charges from the sum offered by BROKEN CAR COLLECTION JSGH LTD.
8. That if registered and required to do so the vendor will account tothe IRD for any GST payable on this sale.
9. That the option to offer my vehicle for sale through the BROKEN CAR COLLECTION JSGH LTD auction process has been explained to me and that I understand this option.
10. That I have not relied on any representation from any staff at BROKEN CAR COLLECTION JSGH LTD as to the value of my vehicle for the purpose of selling it to the BROKEN CAR COLLECTION JSGH LTD.
11. That I will deliver the vehicle with the same equipment and is in as good a condition as when appraised by staff of JS Group Holdings Ltd.
12. THE SELLER AGREES AND CONFIRMS THAT IF ANY DAMAGE TO PROPERTY DURING THE REMOVAL OF THE VEHICLE IS WAIVED AND BROKEN CAR COLLECTION JSGH LTD IS NOT LIABLE
